To the extent that provisions
of the IBC & IRC conflict with the following provisions of State
law, those provisions of the IBC & IRC are not applicable and may
not be enforced.

Special professional services: Where applications for unusual design
or magnitude of construction are filed or where the building official
finds that the construction of the design require special
architectural or engineering inspections, the building official may
require project representation by an architect or engineer. This
project representative shall keep records and submit reports as
required by the building official. All costs associated with project
representation shall be the responsibility of the applicant.

Prosecution of Violation: If the notice of violation is not complied with
promptly, the building official shall request from the Selectmen to
institute legal procedures of the jurisdiction to restrain, correct
or abate such violation or to require the removal or termination of
the unlawful use of the building or structure in violation of the
provisions of this code or of the order or direction made pursuant
thereto.
R113.4
Violation Penalties: Amend, with this to the end.
Each day that the violation continues shall be deemed a
separate offense. Civil violation on conviction, shall be subject to a minimum fine of
$100.00 per day up to a maximum fine of $2500.00 per day, for each
violation, which fine shall be recovered (as the result of the
violation) for the sole use by the Town. Such persons shall also be
liable for court costs and attorney fees incurred by the
municipality.
