 Building Code Amendments

 

 

Nothing herein contained shall be deemed to nullify any provision of the Zoning Ordinance or other ordinances of the Town of Turner pertaining to the location and use of buildings.

 

Except as noted below the Building Code of the Town of Turner includes

           

            1. The 2003 version of the International Building Code

 

            2. The 2003 version of the International Residential Building Code

                        for One and Two Family Dwellings.

 

Laws in conflict with the IBC & IRC

 

            To the extent that provisions of the IBC & IRC conflict with the following provisions of State law, those provisions of the IBC & IRC are not applicable and may not be enforced.

 

            1.  Fire safety codes and standards.    Fire and safety codes and standards                           adopted pursuant to Title 25, sections 2425 and 2465.

 

            2.  Electrical standards.    Electrical standards adopted pursuant to Title 32,                                       section 1153-A.

 

            3.  Plumbing code.   The plumbing code adopted pursuant to Title 32, section                          3403-B

 

            4.  Oil and solid fuel burning equipment standards.  Oil and solid fuel burning                                  standards adopted pursuant to Title 32, section 2313.

 

            5.  Propane and natural gas equipment standards.    Propane and natural gas                                  standards adopted pursuant to Title 32, section 14805.

 

            6.  Boiler and pressure vessel standards.    Boiler and pressure vessel standards                              adopted pursuant to Title 32, section 15104-A.

 

            7.  Elevator standards.   Elevator standards adopted pursuant to Title 32, section                               15228.

 

            8.   Energy efficiency standards.   Energy efficiency standards adopted pursuant                                to Title 32, section 1415-D

 

 

Deletions and additions shall be as listed

 

R101.1 These regulations shall be known as the Building Code & the Residential Code for One and Two Family Dwellings of the Town of Turner Maine and shall be sited as such and will be referred to herein as “this code

 

R103.1  Delete and add the following:

R103.1  Building official: This code shall be administered by the Code Enforcement Officer herein after referred to as the Building Official.

 

R103.2 Delete and add the following:

R103.2 Appointment: The Code Enforcement Officer shall be appointed or reappointed annually by July 1 by the Board of Selectmen.

 

R103.3 Delete and add the following:.

R103.3 Special professional services: Where applications for unusual design or magnitude of construction are filed or where the building official finds that the construction of the design require special architectural or engineering inspections, the building official may require project representation by an architect or engineer. This project representative shall keep records and submit reports as required by the building official. All costs associated with project representation shall be the responsibility of the applicant. 

 

R105.2 Work exempt from permits. Under building exemption #1 amend by removing 200 sq. ft. and replace with 120 sq. ft.

 

R105.3.1 Action on application: Amend: Replace reasonable time and add  60 days.

 

R108.2  Delete and the following:

R108.2  Schedule of permit fees. Fees for each plan examination, building permit and inspections shall be paid in accordance with the following schedule. The Selectmen shall have the authority to review and revise the fee schedule.

 

            New construction                              $20 Plus $0.10/sq.ft. of total floor area

 

            Accessory structures                         $20 Plus $.05/sq.ft. of total floor area

 

            Barns & storage sheds                      $.05/sq.ft. of total floor area

 

            Additions                                          $20 Plus $0.10/sq.ft. of total floor area

 

            Alterations                                        $20 Plus $2.00 per $100 of total cost of                             

                                                                         construction

            Decks, open porches, car ports         $10 Plus $0.10/sq.ft.

 

            Foundations (only)- with no house   $20 Plus $0.10/sq.ft. of total floor times 25%

 

            Mobile home pitched roofs               $10 plus $0.10/sq.ft. times 25%

 

            Placement (mobile or modular home) $20 Plus $0.10/sq.ft. of total floor area.

 

            Demolition permit if not associated with new structure   $25

 

            Swimming pool                                        $25

 

R113.3 Delete and add the following:

R113.3 Prosecution of Violation: If the notice of violation is not complied with promptly, the building official shall request from the Selectmen to institute legal procedures of the jurisdiction to restrain, correct or abate such violation or to require the removal or termination of the unlawful use of the building or structure in violation of the provisions of this code or of the order or direction made pursuant thereto.

 

R113.4 Violation Penalties:   Amend,  with this to the end.

            Each day that the violation continues shall be deemed a separate offense. Civil violation on conviction, shall be subject to a minimum fine of $100.00 per day up to a maximum fine of $2500.00 per day, for each violation, which fine shall be recovered (as the result of the violation) for the sole use by the Town. Such persons shall also be liable for court costs and attorney fees incurred by the municipality.
