RESULTS

To Charles Poland, a resident of the Town of Turner in the County of Androscoggin and State of Maine.

 

In the name of the State of Maine, you are hereby required to notify and warn the inhabitants of said Town of Turner in said County and State, qualified by law to vote in Town affairs to meet at the Turner Municipal Office Building in said town on Friday, the 4th day of April 2008 at 12:55 o’clock in the afternoon, then and there to act upon Article 1 and by secret ballot on Article 2, as set out below, the polling hours therefore to be from 1:00 pm until 7:00 pm in the evening:

 

And to notify and warn said inhabitants to meet at the Leavitt Area High School Cafeteria, in said town, on Saturday the 5th day of April 2008 at 9 o’clock in the morning then and there to act upon Articles 3 through 73 as set out below, to wit:

 

Article 1:  To elect a moderator by written ballot to preside at said meeting.

Nominations:  Ira Goodwin.  Mr. Goodwin was elected with 31 votes.  Motion and second to adopt the Maine Moderators rules for this meeting and to modify it by allowing the Moderator to accept multiple motions on articles to raise and appropriate money, voting on the higher amount first.  Voted unanimously to adopt as modified.

 

Article 2:  To elect all necessary Municipal Officers and School Committee Members – One Selectmen, for a three year term, One School Board Director for a three year term, and One Budget committee Member for a two year term and Three Budget Committee Members, each for a three year term.

 

The polls were opened at 1:00pm and closed at 7:00pm.  Ther results were as follows:

One Selectmen for a three year term; Keene, Richard with 71 votes, Rose, Sr., Calvin with 45 votes, Timberlake, Jeffrey with 55 votes.  Mr. Keene was declared elected.

 

One MSDA#52 Board Director for a three year term; Hathaway, Larry with 54 votes declared elected.    

 

Three Budget Committee Members for a three year term; Caldwell, Ralph with 15 votes, Chasse, Michael with 8 votes, Maher, Stephen with 8 votes were declared elected.

 

One Budget Committee Member for a two year term; Terreri, Elaine with 4 votes was declared elected.

 

Article 3:  To see if the Citizens of Turner will vote to accept as a Town Way Buck Lane so called, as described on the subdivision plan for Howes Corner Estates dated January 14, 2004.

( 1600 estimated feet of road surface) effective upon receipt of a Warranty Deed to the Town and a statement of value.

 

Motion and second to hear Article 3 as written.  Discussion:  Eva Leavitt stated that this article was defeated at last year’s meeting.  Ms. Leavitt then stated that this road has been inspected and approved by an Engineer and that the road has been built according to the plan.  Mr. Jeffrey Timberlake stated that all three of the roads for consideration of town acceptance have been built to town specifications.  There was then a discussion regarding recommending that 3 occupancy permits be issued before any road should be accepted by the town.  Mr. Timberlake made a motion to amend Article 3 to state that 3 occupancy permits will be issued before town acceptance.  The motion to amend was seconded.  There was then a discussion regarding the maintenance of these roads.  The amendment to Article 3 passes by a show of hands.   Article 3 passes by a show of hands.  78 in favor 57 opposed.

 

Article 4:  To see if the Citizens of Turner will vote to accept as a Town Way Shire Lane so called, as described on the subdivision plan for The Shire Subdivision dated March 7, 2007

( 690 estimated feet of road surface)  effective upon receipt of a Warranty Deed to the Town and a statement of value. 

 

Motion made by Mr. Timberlake to approve Article 4 as written in the warrant with the added condition that 3 occupancy permits will be issued before town acceptance.  Motion seconded.  Discussion ensued regarding maintenance and the marketing of lots.  Mr. Timberlake withdrew his motion, second also withdrawn.  Motion and second made to hear Article 4 as written.  Mr. Kenji DeLige stated that he feels turning onto County Road from Route 4 to then turn onto Shire Lane could prove to be a problem for cars stopping.  Mr. DeLige stated that he has video tapped this corner and sent his findings to a University of Maine Professor who has stated that he agrees with Mr. DeLige.  Mr. DeLige then stated that Shire Lane does not meet National Board Design Standards.  Mr. Timberlake stated that the Planning Board had great concerns when reviewing this project.  Mr. Timberlake stated that the State had reviewed this road construction plan and that the state agreed that the plan for this road proved to be safe.  Mr. Timberlake then stated that Pineland Engineering had inspected and approved the construction of this road.

 

Motion to call the question.  Voted by 3/4 show of hands to call the question.

 

Article 4 passes by a show of hands.

 

It was then stated that the amendment to Article 3 should be reconsidered.  There was a motion and a second to reconsider Article 3.  After a show of hands the motion to reconsider Article 3 fails.

 

 

 

 

Article 5:  To see if the Citizens of Turner will vote to accept as a Town Way Bluff Drive so called, as described on the subdivision plan for Wilson Bluff Subdivision dated June 14, 2006 estimated 680 feet of road surface plus the turnaround having a 335 foot circumference) effective upon receipt of a Warranty Deed to the Town and a statement of value.

 

Motion and second to hear Article 5 as written.

 

A discussion ensued regarding additional shoulder work needing to be done on this road.  Mr. Timberlake made a motion to add as a Condition that after the shoulder work had been completed and an inspection done by an engineer that the town then accepts this road.  Mr. John Maloney then stated that this road should not be accepted with such a Condition because this was not correct procedure.  Mr. Timberlake then withdrew his motion, the second was also withdrawn.  It was stated that his road does not meet town specifications since additional work needs to be completed.  Also an engineer’s approval has not been secured.

 

Article 5 fails by a show of hands.

 

Mr. Ira Goodwin has stepped down as Moderator, Mr. Charles Dingman has been appointed as Deputy Moderator.

 

Citizen Request

 

Article 6: To see if the Citizens of Turner will vote to dissolve the “Turner Center for the Arts Board of Directors”, which was established at the Annual Town Meeting of April 7th and 8th 2006 and return all funds allocated in the proprietary fund known as “The Turner Center for the Arts” to the Town’s general surplus.

 

Explanation: This article if approved, would dissolve the Board of Directors called Turner Center Arts Board of Directors and return all funds presently standing in the Proprietary Fund known as “Turner Center for the Arts” to the Town’s general surplus. It would allow the Turner Center for the Arts to become a non-profit entity.

 

Motion and second to hear Article 6 as written.

 

Mr. Dennis Richardson addressed the citizens of Turner.  Mr. Richardson stated that he is the citizen that requested this Article be voted upon at today’s town meeting.  Mr. Richardson stated that while he was a Selectmen he supported the Turner Center for the Arts and is still supportive.  The question is now raised, should it be a “Town Board”?  Mr. Richardson also stated that there has been a lot of hostility among some town’s people regarding this issue and that long time friendships have been lost.  It appeared that things were running smoothly until the rent was not being paid to the landlord, The Leavitt Institute.  It was also stated that some Board Members were asking the town to pay them a salary.  Mr. Richardson stated that the Board of Directors of the Turner Center for the Arts believed to be under the Town “Umbrella”; therefore the town of Turner would be responsible for any debts that could not be paid by the Turner Center for the Arts.  Mr. Richardson asked “should this organization be under the umbrella of the town or become a private non-profit entity?”

 

Mr. Arnold Roy then addressed the citizens of Turner.  Mr. Roy stated that he had been a member of the Board of Directors for the Turner Center for the Arts for the past 4 months.  Mr. Roy then stated that he believes that this Arts Center is very important to the community and that the Board of Directors should not be dissolved.

 

Mr. John Zocchi, a member of the Leavitt Institute Building Board, then addressed the citizens of Turner.  Mr. Zocchi stated that this article intends to determine whether or not the Turner Center for the Arts will continue as an integral part of town government.  A yes vote will end this privileged status; a no vote will permit it to continue.  Mr. Zocchi stated that the Leavitt Institute Building Board would like to end its relationship with the Turner Center for the Arts.  Mr. Zocchi stated that the rent is now $10,500 in arrears.  Mr. Zocchi stated that this rental income is needed for the upkeep of the building and was counted on. Mr. Zocchi stated that the town of Turner should not be responsible for the Turner Center for the Arts bills.  The intention of the relationship with the Turner Center for the Arts was to be of no cost to the town.  Mr. Zocchi stated that the Board Members for the Turner Center for the Arts came voluntarily to the Leavitt Institute Building Board to rent the second floor of the building.  Mr. Zocchi stated that the rental income from this second floor was the primary source of income for the Leavitt Institute.  The first year’s rent was agreed upon for $12,000 and the second year for $15,000.  When there was a revenue shortfall to the Arts Center the rent stopped being received by the Leavitt Institute.  There has been $500 in rent per month received since July 2007.  Mr. Zocchi stated that the Turner Center for the Arts should not be under the Town of Turner’s government and Turner should not be responsible to pay their bills. 

 

Mr. Ira Goodwin then addressed the citizens of Turner.  Mr. Goodwin stated that he feels there is a sense of responsibility to the Leavitt Institute.   The original intension was to lease the second floor of the Leavitt Institute to generate revenue to cover expenses.  The School Board of MSAD #52 had leased space until June 2004; the rental space was then vacant form July 2004 until October 2005.  The Leavitt Institute Board and the MSAD #52 Board did not agree to terms to renew the lease in 2004 and the MSAD #52 Board chose to vacate the building.  The rental of the space in this building again was to generate funds to cover expenses.  Mr. Goodwin stated that it would have been a better decision to have kept the School Board as a tenant.  Since July 2004 the Leavitt Institute has been a financial burden to the town.  Mr. Goodwin stated that it is not in the best interest of the town to have one Town Board versus another.  Mr. Goodwin stated that this issue has become very heated with many town’s folks and that all parties involved need to work together.

 

Selectmen, Ms. Joan Bryant-Deschenes then addressed the citizens of Turner.  Ms. Bryant-Deschenes stated that this issue has consumed an exuberant amount of the Board of Selectmen’s time.  Ms. Bryant-Deschenes stated this issue was important to the town but that the town should not be responsible for paying the bills of another Board.  However because the Board of Directors of the Turner Center for the Arts is under the umbrella of the town, the town may have to pay their bills.  It was also stated that the town was never informed of paying the salary of the Co-Directors of the Board of Directors of the Turner Center for the Arts $20.00 per hour.  Mr. Bryant Deschenes stated that she felt the Turner Center for the Arts could survive alone.  Ms. Bryant Deschenes stated that she would like to see a written ballot.

 

Ms. Heather Hunter then addressed the citizens of Turner.  Ms. Hunter stated that she would like to see all the Boards involved work together.  Ms. Hunter stated that the Turner Center for the Arts is a great asset to the town of Turner.

 

Motion to call the question.  Voted by 3/4 show of hands to call the question.

 

Written ballot taken.

 

Article 6 passes by a vote of 105 in favor of dissolving the Turner Center for the Arts Board of Directors.

 

There were 47 vote opposed to dissolve the Turner Center for the Arts Board of Directors.

 

Mr. Goodwin returned as moderator.

 

Article 7: To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 12,825 for Turner Center for the Arts and to raise and or appropriate $ 12,825 for such purpose.

 

Board of Selectmen make no recommendation.

Budget Committee recommend $ -0-

 

Jim Talbot moved to hear Article 7 with the following Conditions:

 

  1. Turner Center for the Arts becomes a private non-profit entity.
  2. Payments per month of $500 continue to the Leavitt Institute as agreed upon.
  3. The amount raised in this article shall be paid by Turner Center for the Arts to the Leavitt Institute Building Fund towards rent.
  4. Contract signed between both parties for the agreement of rental of space.

 

Mr. Talbot’s motion was seconded.

 

A point of clarification was made that the Turner Center for the Arts has not yet secured a private non-profit status.  The comment was then made that if the Turner Center for the Arts were no longer under the “Town Umbrella” that the town could not dictate how any funds were spent. 

 

Ms. Jennifer Wadsworth then addressed the citizens of Turner and stated that this issue is a mute point.  Ms. Wadsworth stated that since the Board of Directors for the Turner for the Center of Arts has just been dissolved no funds should be appropriated.  Ms. Wadsworth stated that the Turner for the Center of the Arts does not have the resources to become a private non-profit entity.  The Board of Directors has been dissolved and the Turner Center for the Arts is no longer.

 

Motion to call the question.  Voted by 3/4 show of hands to call the question.

 

Mr. Goodwin reread Article 7 with the Conditions included in the motion.

Article 8: To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 387,694 for Administration and to raise and or appropriate $ 387,694 for such purpose.

Discussion regarding why different amounts recommended.  The answer is the increase of flex benefits are reflected in the higher amount recommended.  A discussion ensued explaining flex benefits.

$20,000 for Town Office Furniture, expanded Security System, and Landscaping and to appropriate $20,000 from the Town Office Building Reserve Account.

 

Board of Selectmen recommend $20,000.

Article 10: To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$10,000 for Accrued Absences Reserve and to appropriate $ 10,000 from Surplus for such purpose pursuant MRSA Title 30-A section 5801, 5802.

 

Board of Selectmen recommend $ 10,000.

Budget Committee recommend $ -0-

 

Motion and second to hear Article 10 as written.

 

Discussion:  The question was asked what is this sum for?  Ms. Leavitt explained that this is a reserve for compensatory time should an employee decide to terminate their employment.

There was a discussion regarding the correct amount for Article 14, which was confirmed by Ms. Leavitt as $10,000.  Voted to hear Articles 11 through 19 as one vote.

 

Article 11: To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 20,000 for Obsolete Building Reserve Account and to raise and or appropriate $ 20,000 for such purpose. Pursuant MRSA Title 30-A section 5801, 5802.

Article 12:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 10,000 for Unemployment Fund and to raise and or appropriate $ 10,000 for such purpose pursuant MRSA Title 30-A section 5801, 5802.

Article 16:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

Article 17:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

Article 18:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

Article 19:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 90,300 for Fire Department and to raise and or appropriate $ 90,300 for such purpose.

Article 20: To see if the Citizens of Turner will vote to rename the Fire Truck Reserve account to Fire Department Equipment Reserve Account.

Motion and second to hear Articles 21 through 26 as one vote with the sum recommended by the Board of Selectmen and Budget Committee.  Voted to hear Articles 21 through 26 as one vote.

 

Mr. Kurt Youland made a motion to amend the amount in Article 21 to $10,000.  His motion was seconded.

 

There was a discussion regarding the expense of new equipment.  A vote was then taken by a show of hands with 29 agreeing to the lower amount of $10,000 and 22 opposing the amount of $10,000.  Article 21 will be changed to $10,000.

 

Article 21:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 30,000 for Fire Truck Reserve and to raise and or appropriate $ 30,000 for such purpose pursuant MRSA Title 30-A section 5801, 5802.

 

Board of Selectmen and the Budget Committee recommend $ 25,000.  Changed by vote to $10,000.

 

Article 21 passes by show of hands with the sum of $10,000.

 

Article 22:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 1,577 for Emergency Management and to raise and or appropriate $ 1,577 for such purpose.

 

Board of Selectmen and the Budget Committee recommend $ 1,577.

Article 23:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 192,339 for Rescue Department and to raise and or appropriate $ 192,339 for such purpose.

Article 24: To see if the Citizens of Turner will vote to rename the Rescue Reserve account to Rescue Department Equipment Reserve Account.

Article 25:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 15,000 for Rescue Unit Reserve and to raise and or appropriate $ 15,000 for such purpose pursuant MRSA Title 30-A section 5801, 5802.

 

Board of Selectmen and the Budget Committee recommend $ 15,000.

 

Article 25 passes by a show of hands with the sum of $15,000.

 

Article 26:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 1,400 for Street Lights and to raise and or appropriate $ 1,400 for such purpose.

 

Board of Selectmen and the Budget Committee recommend $ 1,400.

 

Article 26 passes by a show of hands with the sum of $1,400.

 

 

 

 

Article 27:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 49,750 for Highway Department and to raise and or appropriate $ 49,750 for such purpose.

 

Board of Selectmen recommend $ 45,900.

Budget Committee recommends $ 44,400.

Article 28:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 125,000 for Highway Equipment Reserve and to raise and or appropriate $ 125,000 for such purpose pursuant MRSA Title 30-A section 5801, 5802.

Article 29:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

Article 30:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 313,279 for Winter Roads and to raise and or appropriate $ 313,279 for such purpose.

Budget Committee recommends   $ 285,330.

Discussion:  Ms. Leavitt stated that the first proposal of $313, 279 is for a sixth Public Works position with ½ of the $37,000 salary dedicated to Winter Roads and the other ½ dedicated to Summer Roads.  This would be a union position.  Ms. Leavitt then stated that the second proposal of $304,279 is for 5 positions with extra monies for extra help.  Ms. Leavitt also stated that one of the reasons for an increase over last year is because of the huge increase in fuel and salt.   As we are all aware fuel costs are outrageous.  There was then a discussion regarding the sixth position, which has been authorized for but has not been filled.  There was then a discussion regarding part time help.  Ms. Leavitt stated that it is a struggle retaining part time help, because if the part time person does not want to go out and plow a road at 2:30am they do not have to go.  Part time help is also paid at the union wage rate.  There is also an issue in making sure that any part time help is trained properly.  There was then a statement made by Mr. House that the expenses now are over budget by $47,000.  Ms. Leavitt stated that this was primarily due to high fuel costs. 

 

There was a break at 1:20pm.

The meeting resumed at 1:25pm.

Article 30 passes with the sum of $313,279 by a show of hands.

 

Article 31:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 218,619 for Summer Roads and to raise and or appropriate $ 218,619 for such purpose.

 

Board of Selectmen recommend $ 214,619.

Budget Committee recommends $ 195,365.

Discussion:  Ms. Leavitt stated that first proposal of $218,619 is again for the sixth position with the same reasons for this amount as discussed in Article 30.  Ms. Leavitt stated that the difference between the amount recommended by the Selectmen was the Flex benefits.

Ms. Leavitt stated that the staff at the Transfer Station has been reduced to 2 employees on Tuesday and 3 employees on Friday and Saturday thus saving some funds in this area.

 

Representatives form Senior Plus and Western Maine Transportation were given permission to address the citizens of Turner.  A Turner resident from the Rural Community Action Ministry also spoke.  All of the representatives whole-heartedly thanked the Town of Turner for its generosity over the past year and asked for the Town’s continued support. 

 

Article 32:  To see if the Citizens of Turner will vote to spend a sum of money not to exceed

$ 172,980 for Transfer Station and to raise and or appropriate $ 172,980 for such purpose.
